Do I Have Right In Ancestral Property After Partition By Grandfather
08-Jan-2025 (In Property Law)
We have 3 acres property
Grandfather -2 acre from partition with his brother
Grandmother -1 acre(self acquired)
Both died without writing any will.
My father(only heir) is willing to give it to me.we are 3 children(2daughters,1son(me))
Is it possible to give me without release deed from my sisters
The property to be an ancestral property, it has to be seen from whom your grandfather acquired it. If it was acquired from his father then it would be ancestral in nature and all 3 of you will be having equal rights over the property. On the other hand if it was your grand father’s self acquired property then it does come under ancestral property your father can settle it to you. To avoid future litigations it would be better if your siblings sign in the settlement deed
