Distribution done by signing paper now brother is denying what to do

I own & possess the non rural agriculture land since 1997. Which distribution done in family with mutual understanding on piece of paper,which approved by nayab mamaltdar in 1997. Now land prices are sky high so my brother appeal under RTS, claiming he is not aware of distribution,due to his heart disease. So, can his claim sustainable after 15yrs under condone of delay ? What precautions should i take to make my case strong ?

First of all will request you to kindly provide us with complete facts. By property paper's do you refer Sale Deed?



It is pertinent to mention the properties can be transferred in following manner:



1. Sale of Immovable property( Pursuant to sale deed)



2. By will (after death)



3. By Lease ( Right to enjoyment of property)



Please specify what paper's you signed.



Further, also specify whether the Will was registered and whether you applied for Probate.

Firstly, you have to file written statement in RTS proceedings with objection of delay of 15 years and then file civil suit for partition which is done on paper executed by you and your brother.
Your brother has no right to start RTS proceedings, if he is not happy for partition then he has to file suit for repartition. As per rulings of court revenue records does not create title.
