Dispute with Father over Property Share

29-Sep-2023 (In Property Law)
Hey, i am a single 38 yr old woman, i have been supporting my parents since I first took a job 15 odd years ago, after my dad retired - i have supported them entirely as dependents - paying their bills, paying their loans, health insurance, medical, etc. Today, my dad wishes to sell the house we are all living me (me/my mom/ dad) and live separately because of a tiff we had. My questions: 1) My dad inherited the property from my grandfather, so i assume its an ancestral property and his legal heirs have claim to the same. 2) My mom wishes to separate, does she have a claim to the half of the property as well. 3) Since i have supported my parents for more than 15 years, can i claim a share as well?

This my response to you:
1. It is ancestral property if it has been passed down from 4 generations of male lineage;
2. Since it is ancestral property you can stake a claim on it;
3. If there is some dispute then you must issue a legal notice;
4. Then if matters do net get resolved then file a suit;
5. In that suit file an application for stay of sale and injunction against any misuse of it;
6. Consult a local lawyer and take steps.

First of all you need to specify the type of property you have i.e. ownership or tenanted and depending on that you can determine what legal step you can take. Also your mom definitely have right in the property and if it is a inherited property you can definitely claim your share so you have to show your property details and accordingly take legal steps
