Dispute over House property for which will has been made.
03-Jun-2023 (In Property Law)
My father bought a house by his earning and we are currently living in that house. We have no other property.
My father registered a will whereby house after his death pass to his wife and after her the house is equally divided between his two sons.
The dispute is my married elder sister also wants share in the house.
What should we do ? Does she has a right in her fathers individual property?
Please answer.
As the property is self acquired, daughter or anyone can not claim. Only the Father has the legal right to transfer the title at its own discretion.
So nothing to worry and if she takes an action, move to court for objection and have mutation as per will or gift deed by father to son.
Regards
She has no right. Fathers wish as spelt out in the Will is final and conclusive. That’s because a person has full right to decide the mode and manner and method of disposal of self acquired property. Your father decided that post his death, the property will go to your mother and post mother it will be divided equally in between the two sons. Nothing wrong in this
