Delay in Construction and handing over of property

I was purchasing a property from a builder but almost 5 years have past so far and yet to get the property. The property is part of an under construction project and was supposed to be handed over by 3-3 1/2 years. Now, I want to get the money I paid, back from the builder - what should I do?

serve a legal notice demanding for the refund of the principal amount with interest of 12% pa. However the Conswequences Cause of sale agreement needs to be reviewed to get the clear view of terms and conditions of sale agreement. You can approach WBHIRA if your project is registered under HIRA else a civil court for getting redressal of your grievances.

As per your query in law rato if you want you can file a case in consumer forum and ask for refund along with interest plus compensation and litigation cost. file the case as early as possible Ile a complaint case on consumer forum
