Delay in Completion and handover of Apartment

06-Oct-2023 (In Property Law)
I have purchased apartment in under construction development called Vasant Oasis in Andheri East Mumbai by Seth Builders. As per agreement Handover is in Dec2018 or maximum 6 months delay i.e. June2018. However actually on ground, Building has reached only up to the plinth level. Hence Practically it is considerable delay in construction. In actual on RERA site, Date of completion is shown as 2022 i.e. 4 years later than what is promised. Require appropriate line of action advice from an advocate already running Vasant oasis cases.

This is my response to you:
1. Firstly you can send them a legal notice, but avoid if you want to approach RERA;
2. Once you approach RERA then you can file a formal complaint;
3. Technically speaking you were promised by RERA to be handed over the property on Dec, 2018 i.e. after delay;
4. So if you still want the flat, then ask the RERA to direct the builder for every month's delay and pay you interest;
5. Ask for compensation for the mental and monetary losses suffered by you;
6. Make the project RERA monitored;
7. If you are unhappy with the builder's promises then ask for refund along with huge compensation;
8. Consult a local lawyer and then go ahead.
