DDJAY Plot Offer of possession without Completion Certificate received

The builder is asking me to clear all dues on offer of possession of a plot in Deen Dayal yojna and will get property registered on my name by conveyance deed. Though he has applied for completion certificate & as per HRERA 95% of the work is completed as per last update i.e. w.r.t to Jan'2025. The concern is there is no completion certificate of the plot. With no CC what difficulties, I may face in future after registration of plot. Please help.

Subject: Legal Advice on Registration of Plot without Completion Certificate (CC) under Deen Dayal Jan Awas Yojna (DDJAY), Haryana Dear sir Your concern is valid and significant under property and RERA law. Registering a plot without issuance of the Completion Certificate (CC) may expose you to multiple legal and practical complications, even if 95% work is completed as per the builder or HRERA portal. Legal Concerns & Future Risks Without CC: Violation of HRERA Norms: As per Section 11(4)(b) of the Real Estate (Regulation and Development) Act, 2016, a promoter cannot offer possession without completing the project as per the sanctioned plan and obtaining a valid CC. A conveyance deed executed without a valid CC may be considered premature and deficient under law. Risk of Penalties or Demolition: Municipal authorities or DTCP Haryana may impose penalties or declare construction unauthorised in absence of CC. Utilities like water, sewerage, electricity connections may be denied or delayed. Mortgage or Resale Issues: Future loan approvals or resale of the plot may become difficult without a proper CC-backed title. Possession Does Not Mean Legal Completion: Possession based on “95% work done” is not equivalent to legal possession under DDJAY or the Haryana Building Code, 2017. Your Legal Options: Demand Written Clarification from Builder: Ask for a written undertaking mentioning expected CC timeline and assurance of regularisation. Also obtain a status report from HRERA portal regarding the project (with updated Form Q & L). File Complaint with HRERA (Gurgaon or Panchkula): Under Section 31 RERA Act, you may file a complaint before HRERA for: Delayed CC, Premature demand of balance payment, Unlawful offer of possession. Conditional Payment with Safeguards: If compelled to register, make balance payment under protest, include specific clauses in conveyance deed that possession is conditional subject to grant of CC. Recommendation: Do not proceed with full and final payment or conveyance deed execution unless the Completion Certificate is officially issued by the competent authority (DTCP or municipal body).
