Daughter's share in grandfather's property.
10-Dec-2023 (In Property Law)
My grandfather has been expired 20 years ago, now maximum property is to the name of grandfather. Previously, it is divided into two brothers on stamp paper. Is there any right of women's share on property?? Second my father wants to sell our share property but he can't sale without consent of my uncle. So what to do??
After the amendment to the Hindu Succession Act in 2005 a daughter would also be a class 1 legal heir in father's property. In your case the property has been transferred in the name of two sons of your grandfather. Now if your father wants to sell his share of property then he will first have to declare his intention to partition the property to the other brother.
If the other brother doesn't agree then he will have file a suit for partition in the civil court and have the properties partitioned by metes and bounds.
