Daughter's right to father's property.

My mother aged 94 years passed away in Feb 2017. She did not claim share in her father's property who died in 1949. His immovable property has passed in his grandsons name. Can I and my brothers now claim a share in this property.

As a daughter as well as a legal heir you are entitled to a share in your father's property if your father has died intestate(without any testamentary document like..will, gift deed etc). If your brother and other members of your family deny your share then you can file a civil case for partition and declaring your share in your father's property.

Whatever share or right your mother held has only devolved upon you after she has expired so you can claim that right if at all the same is available. First you will have to find out whether your mother relinquished her share or her share was shown to have beem given to her in any proceedings, if not then you claim raise your claim
