Cooperative Housing Society - Repair fund

In our housing society in Mumbai, we have 1 bhk (7 flats), 2 bhk (35 flats) and 3 bhk flats (42 flats). 3 bhk flats have 2 door numbers registered with 2 different names but there is only one door to the house. Now our society is planning for building repair and painting and the budgeted expense is around 1.26 crores. For distributing the cost, they are counting the 3 bhk flats (with 2 numbers) as 1 flat and the total cost is divided equally among all flats. Is this legally correct? Are they not supposed to distribute the cost based on square feet? Thanks for your help.

This is my response to you:
1. Apologies, but your query seems to be incomplete and is confusing;
2. By the bare perusal it seems that the 3BHK flat if not divided or partitioned will be considered as one unit;
3. If it is partitioned then the same entry should be there in the property records of registrar, building plan and the property records of the society;
4. So collect all the documents and show them to a lawyer;
5. Then only best legal opinion can be shared.

The Managing committee of the society cannot act illegally and charge extra charge from the 3 bhk but if as per the registration the society has two numbers and are two different unit then they have to bear twice the rate therefore they cannot escape their liability contact advocate with all details
