Commercial shop under pagdi system in south Mumbai

Hi, I need an advise on my the commercial property purchased on pagdi. We had purchased the commercial property in 2014. However there has been no tenancy agreement till date.. we have the rent receipts and the electricity bills of the premises from 2014 till March 2018 after which the landlord has not agreed to take rent even after several request from our side and he’s also not willing to execute the tenancy agreement now stating it will have huge penalties.. please advice how do I make sure the landlord accepts the rent And since there has been no tenancy agreement at all will making a fresh tenancy agreement draw penalties if we go to register the same now ? Thanks.

This is my response to you:
1. If there was no tenancy agreement it seems there is deemed to be a landlord tenant relationship;
2. You should have paid rent in the court if he was not accepting;
3. You can send him a notice and ask him to enter into an agreement;
4. Consult a local lawyer and take steps.
