Collector Of MUMBAI/Maharashtra Land Revenue ACT
13-Oct-2024 (In Property Law)
We have purchased a flat in Building located on collector s lease hold land which expired in 1994. As on date our building lease expired 30 years ago. I would like to know what consequences will our building face if we stay under expired lease
If your building is on collector’s leasehold land and the lease expired 30 years ago, there could be several consequences. Firstly, you may face penalties or fines from the government for staying on the property without renewing the lease. The authorities could also take steps to reclaim the land, although such actions are usually rare and would likely involve a legal process. Additionally, without a valid lease, you may have difficulty selling the property or getting approvals for redevelopment, repairs, or other changes.
It is highly advisable by me that you have to renew the lease agreement with the collector by regularising it and once you have done with the resolution you need to perform the assignment deed which will help you with the concrete strong property documents
