Co-ownership in apartment and matrimonial dispute

23-Mar-2024 (In Property Law)
Is it possible to reclaim full ownership in a co-owned property in which the co-owner has not paid any EMI on bank loans or any significant financial contribution for the acquisition of the property and no monthly maintenance or property tax payments? The co-owner is also not residing in the property. The co-owner is also the co-borrower in the bank loan and there is an ongoing matrimonial dispute (DV) between the co-owners in the initial stage.

Yes it is possible to claim the full ownership of the flat or any co-owned property by filing the case in court for claiming the complete ownership of the property even though there are matrimonial dispute pending between the parties. You should hurry in claiming the ownership before any order of residence in that property is passed in pending matter.
