Co owner of flat with father can my sister claim after father's death

I am a co-owner of a flat purchased by my father,my father and mother have expired leaving behind myself and my sister as legal heirs without any will, and i have been paying the emi for the said flat and no contribution from my sister,I would like to know whether my sister is ellgible for any right to the said flat, if yes then what will be the % of her rights

If you are a co-owner of the flat purchased by your father, then after the death of your father and mother , you have the major rights in the said property. Your Sister will also have right as daughter's has right in their father's self acquired property. Thus, your sister will entitle for 50 % share in your father's property. Therefore, being co-owner you and your father holds 50% share in the said flat. And your father's share of 50 % in the said property will be equally divided in to two proportionate for you and your sister as your mother also deceased

Your Sister is Entitled to have right in your Father's Flat. She can claim Right to the extend of Fathers Share. Though You can Claim the Money you have spent for the said Flat (EMI). Had there been Will Executed by Father , Things would have been Different.
