Legal Notice to Co-Owners First, send a legal notice to the co-owners requesting them to pay their share of the property tax. Mention that non-payment could lead to legal action and penalties. 2. Filing a Civil Suit for Contribution Under Section 69 of the Indian Contract Act, if one co-owner pays the full property tax, they can recover the share from others by filing a Civil Suit for Contribution in the Civil Court. The court may direct the non-paying co-owners to reimburse the amount with interest. 3. Property Tax Liability & Municipal Action If the property tax is not paid, the municipal corporation can impose penalties, interest, and even attach the property. To avoid this, the paying co-owner can request the municipal authorities to recover the unpaid share directly from the defaulters. 4. Partition Suit (If Dispute Escalates) If the issue persists, you can file a Partition Suit in court to either divide the property or auction it, so that you are not burdened with unfair expenses.
