co-opted member in society committee

16-Jan-2023 (In Property Law)
Dear Sir I stay in Mumbai. Our society have 8 members in managing committee elected 2 years back. Of which 2 members have resigned 6 months back from committee 1 is treasurer and 1 casual member. Chairman and secretary last month Dec'18 appointed internally without informing election authority. myself and one more active member are appointed as co-opted casual committee members. As of now i came to know co-opted appointing internally is not allowed and has to be informed election authority about the filling before. My question - is it correct to appoint co-opted member in committee internally by chairman and secretary as of today. or has to be informed election authority first. pls guide Thank you

This is my response to you:
1. There is improper compliance of procedure of the society bye-laws and the election process;
2. You can dissolve the committee and conduct re-election;
3. Consult a local lawyer and take steps.
