Sir, in 20X60 plot, shared by 2 brothers,elder (A) younger (B),This is based on a Registered will made by their father. The will says,in the said propoerty, (A) will get 17X45, where as B will get 15X30(back portion),comman passage will be 3X45,B can only enjoy and cant sell the property, even if he marry , wife and he can give it for rent or lease, but cant sell, only if the get a son , son can sell,if the person dies with out marriage and after wife death, this property will go the "A".Now "B" married a widow lady, who has a son(not born to B),is this son will become a legal heir of "B"???
As per Hindu Laws only legally adopted son has a right to claim share in his father property. In your case since your son is not legally adopted by "B" cannot claim any share in "B" property unless and untill he execute any sort of testamentary documents.
