22-Dec-2023 (In Property Law)
we are hindu. my wife living in chennai. the properties (30 diff pattas) located in our native village. the properties are her grandfathers and few are grandfathers father.few of the properties are in her fathers and uncles (4 Nos) name but purchased by her grandfather. her grand father enacted a will died in 1996 but her father and her uncles are not yet acted accordingly, and disputing each other over the properties. . but they occupied their part of the land and constructed houses and doing agricultural activities. in 2009 my wife's father by paying bribe and influence converted/ registered with out origional documents and executed gift deeds ( 4 properties) to his son's and My wifes Mother's name. in 2014 the son executed a sales deed in the name of his brother in law in pretext of getting loan. now my wife's brother refuses to hand over the property. he says all the properties of the grandfather belongs to him only. now he started selling the property. what to do?
The will of your wife's grandfather has to be examined in order to understand what properties were bequeathed by him and to whom. If your wife's grandfather had left some properties in favour of your wife's father through the will, those become the absolute assets of your wife's father, and he could deal with them in any manner he deems fit during his lifetime.
