Claiming right in fathers property if father is of unsound mind
10-Oct-2023 (In Property Law)
My father is mentally challenged. Parents got separated when I was born. I was raised by mom at her parents house without any help from my father's side. Now, I am all grown up ( 26 yrs, hindu) I need a place to live and to start a family of my own. My mom got remarried a couple of years ago. When asked for compensation or to get my share of my father's property to my father family, I have been told, I can't claim it until my father is dead. My grandparent are dead, their sons are taking care of my father. I asked for 1/2 of my father property so that I can buy a place to live in. The money they are offering is way to less than the worth of my father's share. Please advise if I can claim my right now legaly
You have a birth right in your father’s ancestral property. However, you shall only inherit it on his death. Since, this is not an HUF, you cannot claim partition. Unsoundess of mind is not a criteria because of which you can claim your father’s property
