Claiming property without legal hairship certificate

12-Aug-2024 (In Property Law)
Before 17 years I bought a land. Sister of the seller has filed case now claiming that she has right to possess 1/3 of the land. But she has given me emancipation deed with notary lawyer which we have failed to register. Knowing this well she has filed a case against me. To come to the point, she has not yet produced any legal hairship certificate so far in the case. 1. Can I issue a notice to her demanding a legal hairship certificate? 2. Can I file a case in the court to dismiss the case?

hi Felix here, I can well understand your concern from the query raised, in the event of her being your sister for real there is no point in demanding a legal heirship certificate, instead you can state all this and get an order for declaration, thank you, you can contact me for further clarifications
