claim on ancestor property by daughter in law after husband death
29-Oct-2024 (In Property Law)
father in law is present and but husband expired, wife can claim on ancestor property.
She can claim from husbands share as a widow of deceased husband. she has right to claim her husband's property left by him either ancestral or self acquired property , if divison of property was made. it becomes seperate property. she can claim as class 1 heir as per section 8. or if husband has made a will, if this is not the case then she has right to maintenance, residence and charges..
In cases involving ancestral property, a wife can claim her deceased husband's share in the ancestral property. When the husband passes away, his share typically devolves to his legal heirs, which includes his wife and children, if any. The presence of the father-in-law does not eliminate her right to her husband's share, as ancestral property is divided among all legal heirs.
The wife may need to file a suit for partition if her share is not voluntarily granted. It's advisable to consult with a lawyer to understand.
