CIVIL MISELLANEOUS APPEAL GOT CANCELLED BY AN ORDER SO WHAT SHOULD ?

I filed a cma in the district court of Eluru, since the sub court has passed a preliminary order, this CMA got cancelled. The district court passed an order on this CMA stating that the said above. I want to reopen it. what sections are applicable to reopen this CMA. This CMA is for appointing an advocate receiver for the crops from the land which are in disputed.

If your CMA (Civil Miscellaneous Appeal) was dismissed by the District Court on grounds that the Sub Court passed only a preliminary order (not a final one), reopening it depends on the nature of the dismissal. Review Petition – If there is an error apparent on the face of the record, or new evidence, file a review petition under Section 114 CPC r/w Order 47 Rule 1 CPC in the District Court. Restoration Petition – If the CMA was dismissed for default (e.g., for non-appearance), file for restoration under Section 151 CPC. Fresh Appeal – If the dismissal was based on non-maintainability due to it being premature (i.e., before a final order), you may need to wait and file a fresh appeal once a final order is passed by the Sub Court. Urgent Relief – Since your CMA was for appointing an advocate receiver to protect crops on disputed land, you can file a fresh application under Order 40 Rule 1 CPC before the Sub Court, citing urgency and protection of property. Revision Petition – If the District Court wrongly refused jurisdiction or committed a legal error, consider filing a Revision under Section 115 CPC in the High Court. Recommendation: File a fresh application for receiver before the Sub Court and/or file a Review in District Court if grounds exist. Consider a Revision to the High Court if there's a clear jurisdictional error.
