Christian Will is required to be probated

14-Oct-2023 (In Property Law)
My mother died in 2005 leaving behind a WII in my favour for a residential flat in Mumbai. We are Roman Catholics by religion. The WILL is registered in Goa where she had been residing for many years before her death. I want to get the said flat transferred in my name. Is the Christian WILL required to be probated? Kindly advise. Aguiar

This is my response to you: 1. You do not need to probate the Will; 2. You can directly transfer the name by approaching the registrar office; 3. It is always advised that, the Will be probated; 4. Or atleast obtain the letters of administration so that no other Class I or II or III legal heir stakes a claim; 5. So consult a local lawyer and take steps.
