cancellation of purchase of flat after registration
10-Aug-2023 (In Property Law)
Dear Sir, I am a resident of Mumbai and I have purchased a resale flat from a seller and the value is 1.6 crs and I have already paid 50 Lacs advance and rest it to be disbursed thru the bank. The bank had been asking me for a NOC from the society and the society had furbished the same and then they wanted a letter from the society stating that the premises were billed on the land as mentioned on the OC belongs to the same building and the society has been stalling that letter whereas in every society in this area they have been issuing the letter of this kind. When I went to meet the sec of the society, he in fact threatened me that how can I come to his house and told me he will ensure he will not issue any letter and has threatened me and my wife that he will ensure that the property name and share certificates are not transferred though the propery has already been registered. The seller is also not co operative so can I cancel the registration and claim my part money of 50 lacs
in this case you need to go through the sale deed and the purchase agreement which you signed during the purchase. You have to follow the procedure which are there for the cancellation of the flat and what is the compensation to be paid for the cancellation charge.
