Cancellation Of Booked Flat

I have booked one flat which is in under construction stage. i have paid around 11-12 L rupees. all payment is done by cheque .i also gave another cheques especially for an income tax and service tax. Now i want cancel the booking, so builder is charging me 50,000 cancellation amount and telling me that i won't get the amount of service tax and income tax. Which is around 1L rs. I have all payment receipts from builder. and while booking there was no cancellation amount. Please tell me what are my legal options in this case?. How should i go forward with this issue?Help me.
In your agreement was there any clause which stated that the builder would deduct any amount on cancellation. If there is no clause in the agreement you can file a complaint with the police for charging and also file a complaint with consumer form.
