Can wife of deceased son claim share in fathers property

mere bhai ki death ho gayi thi last year, uski marriage 9 years before hui thi abhi uski 5 years old daughter hai, mere brother ki wife ab ghar par nahi rahna chahti and she is claiming half of the father's property, we agree to give her one third of the property in which my late brother was partner, she want to sell half of the property,my brother was not share holder in whole property, the cost of property in which my late brother had share is about 30 lakh and we offered her 50 lakh but she refused and warned us to sell the property to wrong persons or gunda, can she do it?

As per your question, no your bhabhi cannot sell the property as she is not the legal owner of the property. In order to get her share in the property she will have to get the property on her name after producing the legal heir certificate. Even after that she will only get he share in the property and cannot sell the whole property to anyone without the other legal heir's consent.
