Can we sell the property even if case going on for the property

Query: Hello My father bought an house in ayanavaram with a partner befor 15 years back. And we both are separated that house. And now we demolished that and we builted 3 floors and now we are living there . Now the problem is the one of the partner he cheated 100 square feet from us so we have put him a case in high court for cheating this 100 squre feet and the case is going to come to an end . And now that partner is residing next to our house and giving lots of problem daily so we decided to sold the house. And my query is the we can sold that house because it is in the case and I want to know that anyone will buy it or not because it is in the case. please reply for my query.

The property is under litigation.

It is not known whether there is a stay agaisnt the proposed alienation of the property on any application filed by the opposite part in this regard.

To sell a property under litigation is not advisable especially owing to the nature of dispute.

Any genuine buyer will certainly hesitate to buy the property under litigation but the people who want to buy at a very cheaper rate would come forward for buying the same if offered at half the price than its worth.
