Can we make statement of grandfathers property through his will

26-Jun-2023 (In Property Law)
My grand father got some property from his grandfather i.e. ancestral property and earned some on his own. Now can he make some statement according to his will while he is alive for partition? He has three sons and one of them died around 2 years back. Now as some of his self earned property is registered on the name of one of his son, who died. Now his wife is saying to forget all the property with the name of the son, who died and wants to divide the rest of the property. Now my grandfather wants to equally divide his total(ancestral and self earned) property to all. Can he make some statement or what is the way to achieve this? My religion is Hindu.

Generally self acquired property can be given to anybody but ancestral property can only be divided as per rules only. There are so many ifs and buts so please meet personally with all the documents with you.

With regard to self earned property your grandfather can challenge the registered document in civil court .with regard to ancestral property it has to be divided amongst successors, you can not deny share of wife.

First of all your father cant will the ancestral propery in any person. He can only will of self acquire proprty on his name. You need not to worry about the ancestral property of your grandfather and self acquired property can be will by him.
