Can we make gift deed after attaching death certificate of sister

my self,my brother and sister are class-II Heirs for property of my deceased unmarried brother.Sister expired.can me and my brother make gift did to a trust.we will attach death certificate of my sister.Is it accepeted ?if I get power of attorney from brother is the presence of both necessary for signing gift deed?property is in KHAMGAON near SHEGAON
Dear Sir/Madam,
First You and your brother will have to complete the necessary formalities under your applicable law of succession and thereafter once the property is devolved unto you, you can gift the property to the Trust. If you obtain registered power of attorney from your brother his presence may not be necessary for registration of gift deed.
