can we claim grandfather's property if we don't have property papers

my grandfather had build a house in thane for my dad and dad's brother, 25 years ago, we stayed for 3 years there till 1993, due to family fights we shifted to rental house, can i claim by share from that same house? now i am only son of my dad , and dad's brother has a son. we two are the brothers, the house is ground floor for elder, and 1st floor for younger son, we dont have property papers , but i have ration card, driving licence , passport on the same address, can we go ahead to claim that property, can we solve this property issue , how to solve this ? i stay on rent for 22 years

As we can understand from the situation you have provided, the property is of your grandfather. Your query is slient on the fact that is your grandfather alive. If he is then it is his decision to give the house to anybody he wish to. If he is not alive then has he left any will, if not then the house is to be divided in equal shares between the 2 brothers, yes you have a right in the property as it is an ancestral property.
