Can step brother claim share from mothers property

02-Jul-2023 (In Property Law)
We have agricultural land on the name of my grandpaa which is not transferred to his sons(my father and uncles). Few years back my father passed away. I have step brother. We have some property on my mothers name. We are 3 brothers and 1 step brother. so my questions are: 1. What would be the ratio in which the property would be divided among us? 2. Is there a posibility my step brother can claim anything from my mothers property? 3. My paternal property would be divided among us only or my mother would also have any share in it? 4. How to proceed to resolve this issue?plz advice reg-hindu

the succession of your grandfather will consider his descendants i.e. his sons, daughters, wives. if the sons have already passed away like your father has died then the grandchildren will be taken into consideration.
The step brother will also have a right over the property and unless any prior arrangement has been made the property shall be divided equally among all of you. If your step brother was adopted by your mother then he can also claim from her property. Also if he proves that the property with your mother is not her self acquired but ancestral inherited property. mother will also have an equal share in your paternal property.
