Can sister give POA to her brother for selling a house ?

02-Dec-2023 (In Property Law)

We are three adult siblings, two widowed sisters and one brother, having a joint ancestral house in Calcutta. The younger sister lives at Delhi in her own separate apartment. We intend to sell the Calcutta house. Can the sister living at Delhi give a power of attorney in my (the brother) favour for the purpose of selling this house without having to ever visit Calcutta personally ? If yes, then what will be the exact procedure and how long will this PoA remain valid ? Thanks.

Yes a Sister Living in Delhi Can give a Power of Attorney to the Brother which will be Specific for the sale of the property. In that case the said Power of Attorney needs to be registered. An Unregistered Power of Attorney has no value.

The Registration procedure is just a One Day Procedure. Yes the Power of Attorney can also be registered at Delhi without her being personally present at Calcutta. Armed with her Power of Attorney this Calcutta property can be sold. The procedure includes preparing a Power of Attorney Deed and getting it registered by an Advocate. The POA remains valid till the property is sold.
