Can resident in an apartment construct a room on the roof

I want to know about the legality of Construction of a room on the Roof of a Apartment where only 3 floors + Roof right of the Upper Flat owner are there. Can the Owner of the Roof construct a room on a roof if only the floors are allowed in that building. If it is not allowed then what action I can take as a resident of the same building if someone has already constructed the room on the Roof ?
The roof of an apartment society and the parking area are the common area of the building that is supposed to be enjoyed equally by all the member of the apartment. No member is allowed to construct a permanent structure in the common area for own purpose. You can write a complaint to the municipal corporation, they will take appropriate action.
