Can NRI be detained in the country for an ongoing case

23-Aug-2023 (In Property Law)
Hi, Currently involved in a dispute over a property and an ongoing court case for the same, is there a possibility for an NRI to get detained from leaving India after visiting the country for a vacation? Nothing has been brought to attention so far, but I am asking as I have been told to be cautious of any malicious intents. Appreciate your response.

If there is any criminal proceedings filed against you or warrant been issued, then authorities have all the right to stop you from leaving the country on following proper procedure. You can approach the necessary authority or a Court and ask them to permit to travel back to the country of your residence. Please note, that you are only an NRI and not a Foreign Citizen.

This is my response to you:
1. If the other side moves a petition in the court then you may face problems;
2. If they state that your passport be seized then you may face problems;
3. Therefore hire an efficient lawyer who will contest your matter in good faith.
