Can N.O.C be given by sister to transfer inherited portion of propert

26-Aug-2023 (In Property Law)
My father's bungalow in Kolkata, built up by brothers for personal house, is now the inherited property of 5 siblings. The house is being used by 2 brothers. 1 sister is claiming her portion of inheritance against payment and will give only N.O.C as documentation. Kindly advise in such a case is N.O.C acceptable for transfer of inheritance rights among siblings or any other procedure to be followed ?

no you cannot transfer inheritance rights that is your sisters share of the property by using an noc without making a valid transfer. The best method will be to make a gift deed and the property can be transferred in the name all the person who are giving the money so if you want to make a gift deed or if you need further advice regarding this issue you can contact me at my number by paying my consultation fee.

There are several types of ownership in Kolkata. Barely giving a NOC is not enough to accept for transfer of inheritance rights. Your sister need to execute a Deed of Gift, transferring her rights in favour of her brothers.
