Can mother evict son from father's property

My widow mother aged 66 yrs has all her property under the forceful control of elder son. The supreme court ha recently passed a case stating that children have no rights over parents' earned property. I wanted to know if mother can evict the son from the house that is under my dad's name who expired in 2004 without leaving any bill. Also can i file eviction suit on property whose only documents i have currently is the land fees "rashids" ?
You can file Title partition suit in your concerned civil court.
After the death of your father his self acquired property can be distributed among his legal heirs equally.
If he have made any will then the property can be distributed among legal heirs according to Will.
