Can legal heir claim for the diseased property

disput file in april 2007 .suit file in march 2011 by legal hair of babaji chavan. babaji expired on march 1998.property transfered in dec 1998 to brother of babaji on basic of nomination.then his wife on 2004 on expired brother.then feb 2007 to third party(stamp duty paid) . question is can legal hair of babaji get relief from court. what could third party do. third party made as party in dispute in may 2010.
Yes the legal heir can claim the rights over Babaji's property only if the property was sold to the 3rd party with the consent of all the successors/legal heirs. If the property was transferred to the third party without the consent of all the legal heirs then such transfer is not valid and the legal heir can claim his/her rights over the said property.
