Can I transfer pagdi flat from uncles name to my fathers name

My family (Grandfather,Father, and me) are staying in pagdi flat in Mumbai for more than 50 years. However, the flat is in name of my uncle who was also staying in flat initially. However, he has moved out after marriage and now staying in another flat for more than 35 years now. He has given affidavit he or his sons won't claim any rights on flat. Can we transfer the flat from my uncle's to my father's name (who is still staying in same flat). Then is it possible w/o paying any % of current flat cost to owner. Please let me know process.
To transfer property deed of transfer need to be done by original owner in favour of your father.

As your uncles given affidavit for no claim but it is not binding on his sons they can claim their right at any point of time before that you need to do any of above.
