Can I get joint Tenancy Ownership in my mother's property
31-May-2023 (In Property Law)
My mother owns a flat in Mumbai solely in her name. She want to add my name to the property. Both of us are Non resident Indians (NRI). In UK where we live there are 2 ways of adding my name to a property, either "Joint Tenancy" or "Tenancy in Common". I understand that Joint tenancy has "right of survivorship" and in the event one of the joint tenants dies the property automatically passes to the other joint tenant without lengthy court procedures. Is it possible to implement "Joint Tenancy" in India and please can you guide how it can be done.
Yes, you can get the property registered in joint name. Each owner will be a co owner in the property. You need to register the property under joint tenancy so that on the death of the co owner the rights of the property is transferred to other owner of the property.
