Can i build on the house in which my brother has a share

I live in a village and i have built a home on a land. I want construct a upper storey on my present house. Can any of my brother can legally put stay on it. As all our land is not distributed yet. I built my home with mutual understanding in past. In present our relations are facing tough time. But i want to construct a upper storey over my present house. I just want to know that is he liable to put stay on this construction. I am not constructing over any other land. I am construction over already constructed home
AS the property is joint in nature, and you have already built a house in the land with mutual understanding of your brothers, you will have to seek permission before you can start building a floor over the house - as if you start the work and one of your brothers gets a stay order it can cause you loss in monetary way
