25-Jul-2024 (In Property Law)
A married muslim couple jointly and equally shared money for purchase of land and construction of house. The husband has got the property registered in his own name. The family lives in the house. can husband sell property without wife consent or consultation of wife who also shared equally? She has no registered document in her name neither any proof that she gave the money as the bank account of wife was handled by husband and Muslim family being a patriarchal, husband controls everything. What remedy does she have to stop the sale of property in which she lives and has invested?

If the property is self-acquired and solely in the husband's name, he can sell it without his wife's consent or signature. The law recognizes his exclusive ownership and decision-making rights over it.

But if the property is:

  • Jointly owned (e.g., both husband and wife are on the title/deed): Wife's consent is mandatory.

  • Ancestral (inherited through generations): All legal heirs have a right, including sons, daughters, and even the wife in some cases depending on the succession laws. So he can't just sell it unilaterally.

  • Under a legal dispute or court-ordered restriction: Nope, can't sell it freely.

Under the Protection of Women from Domestic Violence Act, 2005, a wife who has invested in a property and is living in it can seek protection against its sale by her husband. The Act recognizes a woman's right to reside in a shared household, which includes a house owned by the husband or his family and where the wife has been living, regardless of whether or not she has any right, title or interest in the property.

If the husband is attempting to sell or dispose of the property, the wife can approach the appropriate court and file an application for a protection order under the Domestic Violence Act. The court may then issue a protection order restraining the husband from selling, disposing or alienating the shared household, and may also direct that the wife's right to reside in the property be protected.

It is important to note that the Domestic Violence Act provides for both civil and criminal remedies, and a wife can seek legal recourse under both. The Act also recognizes that economic abuse, which includes denying a woman her right to property or assets, is a form of domestic violence, and provides for appropriate remedies.

Therefore, if a wife feels that her husband is attempting to sell a property in which she has invested and is living, she can approach the appropriate court and seek protection under the Domestic Violence Act.

Yes the husband can sell the property without taking the consent of the wife. As the property is registered in the name of the husband then wife has no share in the property. She can still claim for her share but only after obtaining divorce from her husband.

Hello Please tell the source from were wife earned money whether she does any job or money she get in her marriage. You have to seek injunction against the sale of property or you can file complaint under domestic violence act and seek residential right in that property when you can get residential right he can't sell property and even you can file suit for prior purchase and get stay on sale of property. If you have minor children then you can file suit on behalf of them by claim that share. Rest it's complicated can be discussed after meeting.
