CAN FLATS BE ALLOTTED WITHOUT OBTAINING OCCUPANCY CERTIFICATE

09-May-2023 (In Property Law)
I am allottee of Group Housing Society. The Society does not have Occupancy Certificate and Completion Certificate but they are registering flats to the allottees. IS IT LEGALLY RIGHT TO REGISTER THE FLATS IN THE NAME OF ALLOTTEES WITHOUT OBTAINING OCCUPANCY CERTIFICATE FROM THE LOCAL AUTHORITIES. What action can be taken against the Society if it is NOT REGISTERED WITH RERA.

not permissible in terms of the apartments acts which are almost applicable in all the states. if this GHS is not registered in RERA, file a case in the consumer court. consumer court is equally efficacious as the RERA
