Can elder brother sell home in the name of mother

We are two brother staying in different houses, Both the houses on my mothers name, mother staying with me. My Elder brother is staying in another house which is also on mothers name. a civil suit is already processed in court for that house. My Elder brother siezed (Kabza) that house by made it vaccant from tenants living there on other floor. We came to know that he is trying to sell that house by some fake papers, But genuine papers is on my mothers name. Now my questiion is that- Can my Elder brother sell the property by making fake papers & what steps we can take priors to avoid this?
