13-Jan-2023 (In Property Law)
Hi Good_-Morning Sir i want to know is it daughter have the rights to challenge the rights on her father property who passed away in 2008, now when mother asked to his elder and younger brother about the properties they said she can file the complaint they will not give anything. When we inquired in village about the same someone informed us who is close to our family they have removed the name of my mother and her younger sister name from property and they have made the papers on there name without the information of the family after my mother Father & Mom passed away. It's a humble request to give me the possibles suggestion for further steps.

first, you need to know about the status of the property in question as to whether it is an ancestral property or your father's own property either bought by his own earned money or which has been gifted to him by a gift deed.
In case of the ancestral property you can move to a civil court and file a case claiming your rights on that property and in case of your father's own property it will be going to the person to whom your father has stated in his final will. if there is no will then you can claim your rights over that property too.
