Can common terrace of a society be sold to anyone ?

our society is 20yrs old, a person had purchased 2 flats on resale, on ground, n 1st floor and he covered 500sq ft,land behind his G,F, Flat and locked top common terrace of 500 sqft, he is telling his previous owners purchased terrace and land from builder. Is it legal ? I think builder cant sale land and common terrace to anyone.

The information provided by you is very limited. you need to check the documents of the purchaser who is having the rights of the terrace. as per your query-- common terrace cannot be sold. kindly check your agreement and of you have the right to terrace then you can claim and break open the locks as well.

As per maharashtra co-poerative housing society act rules and bye laws. The common area space is only for use by any members of society and not for sale. The act of purchaser is violation of the provision of law.
