Can builder charge land under construction tax from buyer

Is the builder justified legally to charge the buyer of flat Land Under construction tax at the time of Posession. No where has this tax being mentioned in the Agreement nor the contract and was never notified to the buyer during the construction process.

No you are not required to pay the same as it not explicitly mentioned in the terms of agreement/contract which is binding on you both. If the builder denies to provide you the possession for the same issue then you can send him a legal notice and if he still denies to comply with the terms and conditions of the agreement then you can file a complaint against him in the consumer forum.
