Can builder ask for extra money which is not mentioned in agreement
07-Jan-2023 (In Property Law)
Hi. We have bought a Apartment in Chennai and have registered in our name too. Now the builder is asking us to pay extra money towards Air Conditioner Outlet fixing charges as per the existing sqft rate. ie 3(Air Conditioner) x 10sqft(Per AC Outlet)=30sqft. Therefore we are asked to pay Rs.1,80,000/- (30-Sqft.XRs.6000) which is not mentioned in out agreement. Pls advise us to proceed.
This demand of money is definitely illegal, and a cause of action arises against the builders. You can file a consumer case against the builder in the District Consumer Disputes Redressal Forum in your local jurisdiction against your builder.
At the very least you should send legal notice to the builder stating that such demand of money is unjustifiable, mala-fide, illegal and without any basis whatsoever in the eyes of law.
