Can brother claim share in father's property if he took his job?

We have a property in Guwahati, Assam and is named in favour of my mom, elder brother and me. My father worked in guwahati refinery corporation limited. After his death my brother acquired his job, in consultation with the authority. Now after claiming my dad's job after his death, is he also eligible to 50-50 share in the property.please guide..

Hi,
Property is already in favour of mom, elder brother and you . so your brother already has equal share in it . Acquiring Father's job after his death does not make any difference to the shares in property and he shall rightfully have share in the property same as you and your mom.

yes you can claim the share of the property of your late father which would have otherwise accrued to your brother as you can make out a case that he should have waived his claim on receipt of the job which refinery had granted him on his father's death...
