Can attested documents be presented instead of original documents
02-Aug-2023 (In Property Law)
in civil case should defendant produce house sale deed and related documents in original? can we produce attested copies instead of originals
If the original copy is produced that is a much better piece of evidence as the same would be treated as primary evidence, however, as per section 65 of Evidence Act even a certified copy may act as a primary evidence. However, if there is no original and a photocopy is produced then that will be a secondary evidence and will have lower value even if the suit is not dismissed.
