Dear Sir,
To be considered a resident of India under FEMA, a foreign national would have to satisfy two conditions:
a. He/she must be residing in India for more than 182 days during the preceding financial year,
b. and His/her continued presence in India in the current financial year must be for the purpose of taking up employment, carrying on business or vocation in India or for any other purpose that would indicate your intention to stay in India for an uncertain period
If you satisfy above conditions then you can purchase property without permission of the Reserve Bank. You will still need the approval of local authorities.
If you have a residence permit but stay in India less than 182 days per year, you need to get permission from the Reserve Bank of India to purchase property.
You are required to provide the following details in order to advice you better:
a. Where you wish to purchase the property?
b. For residential or commercial purpose?
c. Visa details and stay in India
